Specific Terms with respect to Use of Platform for purchase of Cigarettes and Other Tobacco Products
You acknowledge and understand that the tobacco and tobacco products made available on the Platform, can only be purchased by you, if you are over eighteen (21) years of age, or such higher age as may be specified under Applicable Law(s). Therefore, you agree and undertake that you will not use the Platform to purchase tobacco and other tobacco products if you are below the age of 21 years. Further, you represent and warrant that you shall not order tobacco and tobacco products for and on behalf of any person below the age of 21 years. You shall not engage any person below the age of 21 years to order, collect or receive tobacco and tobacco products, on your behalf, from your account.
In this regard, you may be asked to undergo and complete an age verification process on the Platform or otherwise, by furnishing the requisite documents, before the purchase of tobacco and tobacco products on the Platform. You undertake to provide valid and legible documents for the purpose of verification (if required and asked for), failing which you will not be allowed to access the Platform for the purchase of tobacco products. Users shall be solely liable as to the veracity of the documents/information provided by them. We undertake no liability in this regard.
In addition to the above, you may also be required to provide a valid age proof at the time of delivery of cigarettes and/other tobacco products. In the event, appropriate documents are not provided, we reserve the right to unilaterally terminate the Order.
You further represent and warrants that you will comply with all applicable laws and regulations as applicable to the purchase and subsequent sale of tobacco and tobacco products, including but not limited to the Cigarettes and other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, 2003.
You shall ensure that the delivery location is not an area within a radius of one hundred yards of public locations, such as educational institutions, religious places, places of worship, hospitals, healthcare establishments, etc.;
